Playing Offense with Medical/Legal Defense

George Washington once said, "Offensive operations, often times, is the surest means of defense".

Corrections is a litigious field. Agencies could choose to passively wait for healthcare and deliberate indifference lawsuits to be filed. However, a better defense is to be proactive with risk mitigation strategies that intend to preempt having a bad outcome. In this session, two attorneys from the State of Nebraska Attorney General's Office will review how attorneys defend a lawsuit. Their focus will be on what preventive actions are taken in advance by agency staff to aid in that defense; for example, how actions and events are best documented. They will also review important legal precedents that will factor into any response to a plaintiff's allegations. They will be joined by an experienced correctional physician who will make observations on how custody staff may best interact with health care staff for risk mitigation. Example issues will be solicited from the audience.
