The Department of Housing & Urban Development (HUD) released a Final Rule implementing the Housing Opportunity Through Modernization Act of 2016 (HOTMA). This final rule was published in the Federal Register on February 14, 2023. This rule makes sweeping changes to HUD affordable housing programs including changes to the rules regarding income and assets. Because the Housing Tax Credit program uses the Section 8 rules for determining household size, income and assets, HOTMA will impact the Housing Tax Credit Program.
