This session will discuss the types of relationships pharmacies and physicians can have in delivering infusion in the home and suite settings and the types of relationships that must be avoided. Examples include the physician serving as a medical director, the provision of nursing services by one party to the other, and the provision of management/administrative services by a pharmacy to a physician-owned infusion suite. Particular emphasis will be on the federal anti-kickback statute, the federal physician self-referral statute (Stark), state kickback and self-referral laws, and state corporate practice of medicine prohibitions.
