Independent School Collaboration and Antitrust Exposure

Independent schools want and need to collaborate and share information among peers — particularly during a pandemic — but doing so can trigger laws designed to enhance competition. A recent Department of Justice investigation into DC-area schools’ decision to end AP courses is one example of this issue. In this interactive session, experienced education counsel will explore the grey areas of when friendly interschool collaboration can create unanticipated exposure. This session will provide concrete tips and steps to engage in healthy and legal collaboration with peer institutions.

Learning Objectives:

Participants will review what types of actions or conduct may expose themselves and their schools to government oversight or legal action, as well as how to safely navigate collaboration and communication with peer independent schools.
