How do you manage, review, organize, evaluate, and analyze multiple terabytes of digital evidence in a single case? What pieces of digital evidence do you have to provide to the defense? Can you provide your entire evidence file to the defense and satisfy your ethical obligations? What do you do when digital evidence is contraband? This presentation will help answer these questions while providing a walkthrough of the e-discovery process. Through a combination of case law analysis and personal experiences from a former veteran federal prosecutor, the presentation provides an overview of e-discovery requirements and provides strategies for complying with the statutory, constitutional, and ethical obligations of prosecutors. This presentation may qualify for Continuing Legal Education credits in some jurisdictions.
